2. Scope of this privacy policy
This privacy policy explains how muster GmbH processes personal data when you visit the website, order online or contact us. Personal data is information relating to an identified or identifiable person.
3. Personal data we process
Depending on how you use our services, we process in particular:
- contact details such as name, phone number and – if provided – e-mail address;
- for delivery orders, the delivery address and delivery instructions;
- order data such as products, options, amount, delivery or pickup, requested time, status and order number;
- voluntary messages such as order notes and information about allergies or special requests;
- ratings and comments you choose to give after an order and – if provided – an e-mail address for our reply;
- payment information such as the payment method chosen, payment status and reference and transaction numbers;
- for orders with age-restricted drinks, the confirmation of the minimum age and how the age was checked at handover;
- technical data such as IP address, time, pages visited, browser and device information, session and basket data and log data.
Full card or account details entered directly in the payment interface of Wallee or a payment provider are processed by those payment providers. We only receive the payment status and transaction information needed to match and process the payment.
4. Where the data comes from
We receive personal data mainly from you directly, from your use of the website and online shop, from Wallee and the payment institutions involved and from technical service providers where this is necessary for operation, security or troubleshooting.
5. Purposes of processing
We process personal data in particular in order to:
- receive, check, accept, fulfil and invoice orders;
- handle deliveries, pickups, payments, cancellations and refunds;
- keep you informed about your order and answer enquiries – by e-mail if you provide an e-mail address;
- evaluate your voluntary rating and reply to you if you wish;
- check the legal minimum age when alcoholic drinks are handed over;
- provide the website, basket, checkout and payment processing securely and reliably;
- detect and investigate misuse, fraud, technical errors and security incidents;
- meet statutory retention, evidence, tax and accounting obligations;
- improve our services using aggregated operational evaluations.
After ordering you receive a personal link to the status page of your order. Anyone who knows this link can see the status and details of that order, so please do not share it.
Where consent is required, we ask for it separately. You can withdraw consent at any time with effect for the future. Otherwise we process data where this is necessary and permitted for preparing and performing a contract, for complying with legal obligations or for protecting legitimate interests.
6. Recipients and processors
We only pass on personal data where this is necessary for the purposes described. Recipients are:
- Infomaniak, for web hosting, infrastructure and related technical services.
- Infomaniak, for e-mail and communication services.
- test company, as technical service provider with administrative access for support, maintenance and updates; personal data may be accessed where this is necessary for the task in question.
- Wallee Group AG, Neuwiesenstrasse 15, 8400 Winterthur, Switzerland, as payment service provider, and the payment and financial institutions you choose. Wallee may process technical device and session information for payment processing and fraud prevention.
- Federal Office of Topography swisstopo (geo.admin.ch), Switzerland, for address suggestions when you enter a delivery address. Our server sends only the part of the address you typed – not your name and not your IP address.
- authorities, courts or other bodies where there is a legal obligation or where this is necessary to enforce or defend legal claims.
The service providers we use may only process personal data within the scope of their tasks and the applicable contractual and legal requirements. We do not sell personal data.
7. Disclosure abroad
Some of the service providers named above or the payment institutions you choose may also process data outside Switzerland. Where a recipient country does not offer a level of data protection recognised as adequate by the Swiss Federal Council, we or the providers rely on appropriate safeguards, in particular recognised standard contractual clauses, or on an exception provided by law.
8. Cookies and storage in your browser
The website uses technically necessary cookies so that the basket, session, checkout and security features work. Ordering is not possible without them.
So that you do not have to enter your details every time, your browser stores your name, phone number and, where applicable, your delivery address locally on your device after an order, as well as your choice between pickup and delivery. These details do not leave your device in the process. You can delete them in your browser settings at any time.
Wallee may process device and session information to secure payment processing and prevent fraud.
We do not use any analytics or marketing services on this website, which is why there are no separate cookie settings. If such services are introduced, we will update this privacy policy beforehand and obtain any consent required.
9. Retention
We keep personal data only for as long as necessary for the purpose concerned, for performing the contract, for security, for handling complaints or for meeting legal obligations.
Business records and accounting vouchers – which, depending on their content, include order, payment, invoice and refund documents – are kept for ten years from the end of the financial year concerned in accordance with Swiss accounting rules.
Other order and contact data and voluntary information are deleted or anonymised as soon as they are no longer needed for processing, legitimate evidence or possible legal claims.
Technical, notification, security and administration logs are kept only for as long as they are needed for operational security, troubleshooting, preventing misuse or legal evidence.
10. Data security
We take appropriate technical and organisational measures to protect personal data against loss, misuse, unauthorised access and unauthorised alteration, in particular encrypted transmission, role-based administrative access, updates and technical logging. Nevertheless, completely risk-free data transmission or storage cannot be guaranteed.
11. Your rights
Within the scope of applicable data protection law, you can request access to your personal data, have it corrected, handed over or deleted, and object to processing. You can withdraw consent with effect for the future. Legal restrictions, overriding interests and retention obligations remain reserved.
Please send requests to test@test.info. To prevent misuse, we may ask for suitable proof of identity. You can also contact the Federal Data Protection and Information Commissioner (FDPIC).
12. Applicable law
The processing of personal data is governed by the Swiss Federal Act on Data Protection (FADP).
13. Changes
This privacy policy may be amended if the website, the service providers used, the data processing or the legal situation change. The version published on the website applies.
